Gwinnett county uses the Georgia state laws, unless there are ordinances for your local community, like Norcross.

And the new GA law does not allow carts on public streets.

Sorry, but I deal with O.C.G.A every day at work, and know how to read it.

The new law only defines a new type of vehicle, but offers no new privileges to drive on city, county or state roads.

It merely offers a means for local governments to pass ordinances which DO allow that. Some local governments add additional requirements, such as the dorky yellow strobe on top.

Not meaning to be ornery, but there is a lot of misunderstanding on this new law. Many people think if they just comply with the definition of a Personal Transportation Vehicle (PTV), they are good to go on any city, county, or state road.

They could be cited, even if they meet ALL PTV requirements in MOST jurisdictions.

Tryin' hard to beat a dead horse, but anything that says HB or SB AIN'T LAW quite yet. In order to access the TRUE O.C.G.A., go here:

http://www.lexisnexis.com/hottopics/gacode/

Title 40 is the "Motor Vehicle and Traffic" section. You might be surprised to see some changes from the bill we've been following through the legislative session. A Bill is nothing. It has to pass both Houses and be signed by the Governor before it is a Law, and a part of O.C.G.A.

Subject: Golf Carts in Gwinnett

Hi, my name is Kelly Bell. I am a resident of Gwinnett. I have a concern regarding my golf cart. I have a golf cart with lights, turn signals, a slow moving vehicle badge, and a 100 foot amber beacon mounted to it. Is this vehicle OK to use in my subdivision, which is a 25 mph zone? I would like to use it to go to my subdivisions pool and back this summer. I have checked with my Home Owners Association and they have indicated that as long as I adhere to Gwinnetts law regarding golf carts, there is no problem. I am just having problems in finding what Gwinnetts laws are re golf carts.

Maybe if you don’t know, you could forward to someone who could help me?

Thanks for your speedy response to this matter!

Another email exchange between myself and Gwinnett county:

From: David.O'Hare@gwinnettcounty.com [mailto:David.O'Hare@gwinnettcounty.com]

Cc: Gale.Higginbotham@gwinnettcounty.com; Lyndsay.Alimena@gwinnettcounty.com; Faith.McDonald@gwinnettcounty.com
Subject: Low Speed Vehicles (golf carts)

Ms. Bell

The laws regarding a low speed vehicles advise that in a subdivision with the speed limits that you described the use of your golf cart for traveling to and from your pool would be allowed. I am including a chart which will answer the questions that have been forwarded to me. If you should have any further concerns or questions, please feel free to email or call me directly.

Thank you.

Somebody needs to tell GSP troopers on Jekyll this definition. They interpret it to mean lap belts for all passengers. If it's a 2+2 (four people), you'll get a ticket or at least a warning if there aren't 4 lap belts installed. And there better not be more that 4 people riding either. Jekyll Is. Auth. does not require the amber strobe or the slow moving vehicle triangle.

Enforcement is not a problem for me. I drive in Hall and Gwinnett, and occasionally Braselton, as I live where they all intersect.

Your emails reference LSV, and the law I was referencing was for PTV. I'm not certain, how this will play out, as PTV vs. LSV. To be honest, I've never researched the rules for LSVs, so that may offer rights the PTV law doesn't. I was just pointing out the PTV is merely a definition of PTVs.

Most new bills say "All laws and parts of laws in conflict with this Act are repealed."
