Enforcement Policy:



Golf Carts: Golf carts are considered “motorized carts” pursuant to O.C.G.A. 40-1-1 (32) and may be classified as a “slow moving” vehicle pursuant to paragraph (25.1).

Legal Operation of a Golf Cart on Public Roadway



As a motorized cart, a golf cart may operate on roadways when all of the following elements of law are met:



1) during daylight hours only (O.C.G.A. 40-6-330). May, however, operate at night if they meet the equipment requirements of 49 Code of Federal Registry 571.500; and

2) operate only on a roadway with a posted maximum speed limit of 35 MPH; and

3) must be equipped with an amber strobe light that is visible for 500 feet to the rear and front (O.C.G.A. 40-6-362); and

4) the operator possess a valid drivers license (O.C.G.A. 40-5-20 and Coker v. State, Georgia Court of Appeals. June 13, 2003); and

5) Slow Moving Emblem attached to the rear required [O.C.G.A. 40-8-4 (a) ].



Other Restrictions



6) Impeding the flow of traffic prohibited: a golf cart or other vehicles may not drive “at such a slow speed as to impede the normal and reasonable movement of traffic.” O.C.G.A. 40-6-184. This would include a golf cart or other slow moving vehicle operating at 20-25 mph in a 35 mph speed zone that impedes or prevents a vehicle from driving the posted speed limit.

7) Children under the age of 6 prohibited from riding as a passenger, for “a child passenger restraining system” shall be provided in all passenger vehicles (O.C.G.A. 48-8-76).



Registration (tag) is not required pursuant to 40-2-20 (exempts motorized carts), and Insurance is not required pursuant to 34-33-2 (Insurance is only required for motor vehicles requiring registration (tag).



Note: County Ordinance 2-13-56 prohibits any motorized conveyance (golf carts, ATV’s, UTV’s, etcetera) from operating on a sidewalk or bicycle path, and 2-11-16 prohibits operation on any beach and other prohibited areas in county parks and property. Law Enforcement exempt.



Manufactured “Slow Moving” Vehicles such as the GEM Electric vehicles: may operate on roadways during all hours that have a posted maximum speed limit of 35 MPH when equipped with an amber strobe light that is visible for 500 feet to the rear and front, and the operator possess a valid drivers license. Gem Electric vehicles are classified as “Low Speed” vehicles and thus are required to have an amber flashing light to warn other motorist of a slow moving vehicle pursuant to O.C.G.A. 40-8-35, and are equipped with all required lighting to operate during low or no light conditions (headlights, turn signals, brake lights, running lights) as required by 49 CFR 571.500.



Registration and insurance is required. 40-2-20 only exempts motorized carts.

What county is this referring to? Having issues here in Forsyth Co. Do you think this same requirement applies to mopeds and bicycles?

Duffinator, I only know that I just returned from a vacation to Saint Simon's Island, Georgia and there were golf cars and GEM's all over the roads running both day and night. They all had the amber strobe lights on top. I believe that is in Glynn County.

i think this was for the whole state of ga local counties may differ

Rusty, I know that Georgia does have a law that allows LSV's. I am thinking that you are right and that some counties allow modified golf cars as well as LSV's.

I'm still trying to find something on the laws in MS regarding golf carts.

We had this problem in Shellman Bluf, Mcintosh county, and the laws posted are the same as ours, only we have to buy a 12.50 permit every year.

I noticed the same thing while I was on a vacation to Jekyll Island. Golf carts were driving everywhere, all had orange strobe lights and smv triangles on the rear. Some had head and tail lights some none. I believe all roads on JI are 35mph, so that makes it easy. Seeing this has really given me the golf cart bug again.
